When you are a class representative, you are a part of a very exclusive group of individuals. It means labor laws have affected everyone in the class and they are trying to enforce them. Their goal is to be able to convince a judge that everyone in their class has had their labor rights violated and they all deserve compensation. Additionally, this representative has to decide how much money the class representative should receive in special fees. This is all done with assistance from your lawyer.
When a class action takes place usually, several experienced law firms have to represent the class while the employer only has one law firm. The class representative has to work close with the lawyers and get them up to speed on what took place in addition to providing a testimony in a deposition.
This may seem like it is going to take a lot of time. However, the class representative is not overburdened due to their role. Most of the work is taken care of by the law firms since they are the ones who have to do the research for facts and perform legal research.
Usually, the claim is resolved before it has to go to trial through voluntary mediation. When a common ground has been reached the settlement and resolution only has to be approved by the courts. Everyone in the class has to be notified of the projected solution and have the opportunity to remove their claim and branch out on their own or make a comment in court.
