Do I need to file a complaint with the California Labor Board?

California Labor Board ComplaintThe DLSE Department of Labor Standards Enforcement is charged with enforcing working conditions in the State of California. Anyone can file a complaint with the labor board regarding the conditions in a workplace regardless of whether they work there or not. However, before you file you should understand the boards limitations.

You could liken the CLB to a small claims court; they can handle smaller employee issues, but are limited. Generally they will handle claims under $7500.  I would recommend this course of action only when you have a case is too small for a private attorney to take on.

FACT vs. FICTION; THE CALIFORNIA LABOR BOARD:

MYTH: The CLB will investigate all claims and seek to recover all damages I’ve suffered.
FACT: The CLB will only pursue a fraction of what is owed to you and can only go back three years while a private attorney can go back four years as well as investigating additional offenses.

MYTH: If the company I worked for goes bankrupt the CLB will sue my employer individually.
FACT: Only a private lawyer like UELG can attempt to collect from your employer if the company is dissolved. New CA Laws even provide for liens on their property if they fail to pay.

MYTH: The CLB will also collect any attorney’s fees if they win.
FACT: Only an attorney may collect fees when filing a civil suit.

MYTH: Once I win my CLB case, my employer will send me a check.
FACT:  Your employer has the right to appeal any claim and they know it. You are likely to have to start all over and end up hiring an attorney anyway, or just giving up, which is what they hope for.

Bottom line, The California Labor Board is a state agency, need I say more. They handle an enormous volume of claims every year.  The administrating judges must operate with efficiency in mind rushing cases in and out as quickly as is prudent. They simply cannot examine your case in the same way a private Los Angeles Labor Attorney can, which can easily lead to you getting paid less than you are owed, if you get paid at all.
